About these terms
These terms are an agreement between you and [[Legal entity name]], [[Registered office address]], India (“EmbroBuddy”, “we”, “us”). They apply to the EmbroBuddy apps for Android and iOS and to this website (together, the “Service”).
By creating an account or using the Service you accept these terms and our Privacy Policy. If you don't accept them, please don't use the Service. These terms are an electronic record under the Information Technology Act, 2000 and need no physical or digital signature.
Who can use EmbroBuddy
- You must be at least 18 years old and able to enter into a binding contract under Indian law.
- If you register a company or an institute, you confirm that you are authorised to act for it, and these terms bind that business as well as you.
- You may not use the Service if we have previously closed your account for breaking these terms.
Your account
- Give accurate information, keep it up to date, and confirm your email address when we ask.
- Keep your password private. You are responsible for everything done through your account, so tell us straight away if you think someone else is using it.
- One account is for one person or one business. Don't share, sell or transfer it.
- You choose an account type (designer, company or institute) when you first save your profile. That choice is permanent for the account: to use a different type, create a new account with a different email address.
How EmbroBuddy works
- Designers create a profile, search and save jobs, and apply to them.
- Companies create a profile, post jobs, search designers, and move applications through stages: shortlisted, interview, offer, hired, joined or rejected.
- Institutes create a profile and can browse designers, companies and open jobs.
A designer's mobile number and email are shown to a company only after that company shortlists the designer for one of its jobs. Both sides receive notifications in the app as an application moves forward.
Our role
EmbroBuddy is a platform where users find each other. We are not an employer, a recruitment agency or a training provider, and we are not a party to any employment, freelance, training or other agreement between users.
- We don't guarantee that a designer will find work, that a company will find a designer, or that any job, profile or course is as described.
- We may check the format of details such as a GST number, but we don't verify anyone's identity, qualifications, experience, business registration or claims.
- Salary, working conditions, payment and every other term of work are agreed directly between the users concerned.
Do your own checks before you share personal documents, start work, pay or accept money, or travel to meet anyone you found on EmbroBuddy.
Rules for companies
- Post only genuine vacancies that you have the authority to fill.
- Describe each job accurately, including its title, duties, location, job type and salary range.
- Never ask a designer for money to apply, to be shortlisted, for training, for a uniform or for any other reason connected with getting a job.
- Follow the employment laws that apply to you, including minimum wage laws, and don't discriminate unlawfully.
- Use a designer's contact details only to discuss the job they applied for. Don't share them, add them to marketing lists or use them for anything else.
- Close a job when it is filled, and keep each application's stage up to date.
Rules for designers
- Describe your experience, skills, software, salary and availability truthfully.
- Upload to your portfolio only work you created and have the right to show. Embroidery designs often belong to the client they were made for: get permission before uploading them, and never upload designs you have agreed to keep confidential.
- If you are offered a job, check the offer yourself. A real employer will not ask you to pay to get the job.
Rules for institutes
- Describe your courses, services and placement support accurately.
- Don't promise jobs or placements you can't provide.
- Use the contact details of designers and companies only for genuine training or placement purposes.
What nobody may do
When using the Service you must not:
- give false information, or pretend to be another person or business;
- post fake jobs, run scams, pyramid or multi-level marketing schemes, or collect fees from job seekers;
- harass, threaten, abuse or discriminate against anyone, or post content that is obscene, defamatory, hateful or harmful to children;
- upload content that infringes someone else's copyright, design, trademark or other rights;
- send spam, or use contact details from EmbroBuddy for unsolicited messages;
- copy or collect data from the Service in bulk, including with bots or scrapers, or sell or share it;
- interfere with the Service: break its security, get around its limits, overload it, upload malware, or reverse engineer the apps except where the law allows;
- use another person's account, or let someone else use yours;
- do anything unlawful, or that threatens the unity, integrity, security or sovereignty of India, public order, or relations with other countries.
Your content
You own what you upload or write on EmbroBuddy, such as your profile, photos, portfolio images and job posts (“your content”).
You give us a non-exclusive, royalty-free, worldwide licence to store, copy, resize, display and transmit your content, only as needed to run the Service: for example, to show your portfolio to companies in search results. This licence ends when your content is deleted, except for copies kept for a short time in backups or as the law requires. We will not use your content to advertise EmbroBuddy without asking you first.
You confirm that you have all the rights needed to upload your content, and that it follows these terms and the law.
Reporting a problem
If you see a fake job, a request for money, abuse, or content that infringes your rights, report it to [[support email, e.g. support@embrobuddy.com]] or to our Grievance Officer (section 21). Tell us where it is and why it's a problem.
We acknowledge reports within 24 hours and act on them within 15 days. We may remove content, hide a job or profile, or suspend an account while we look into it. We also act on orders from courts and government authorities as the law requires.
Fees
EmbroBuddy is currently free for designers, companies and institutes. If we introduce paid features, we will show you the price and terms before you buy anything, and nothing will be charged without your agreement.
Suspending or closing an account
You can delete your account from the app at any time. How to have your data permanently erased is explained in our Privacy Policy.
We may suspend or close your account, or remove your content, if you break these terms, if the law requires it, or if we reasonably believe your use puts other users, EmbroBuddy or the public at risk. Where it is safe and lawful, we will tell you why. If you think we got it wrong, contact our Grievance Officer.
Sections 10, 16, 17, 18 and 19 continue to apply after your account is closed.
Our app and brand
The EmbroBuddy name, logo, apps, website and their design belong to us. We give you a personal, non-exclusive, non-transferable licence to use the apps and website to find work, find designers or offer training, as these terms allow. You may not copy, modify or resell them.
Changes to the Service
We work to keep EmbroBuddy available and secure, but we may change, add or remove features, and the Service may sometimes be unavailable for maintenance or reasons outside our control. Some app updates may be required to keep using the Service; the app will tell you when one is.
Disclaimer
The Service is provided “as is” and “as available”. To the extent the law allows, we make no promise that it will be uninterrupted or error-free, or that the information users publish on it is accurate, complete or lawful. That information is the responsibility of the user who published it.
Limits on our liability
To the extent the law allows:
- we are not liable for indirect or consequential losses, such as lost earnings, lost business or lost opportunities;
- we are not liable for what other users do or say, or for any agreement, payment or dispute between users;
- our total liability to you for all claims connected with the Service is limited to the greater of the amount you paid us in the 12 months before the claim, and ₹1,000.
Nothing in these terms limits any liability that cannot be limited under Indian law.
Your responsibility to us
You will compensate us for losses and reasonable costs, including legal fees, arising from a claim by someone else that is caused by your content, your breach of these terms, or your dealings with other users.
Governing law and disputes
These terms are governed by the laws of India. If you have a complaint, please contact our Grievance Officer first so we can try to resolve it. If we cannot, the courts at [[City, State]] have exclusive jurisdiction.
Changes to these terms
We may update these terms. When we do, we update the date and version at the top of this page. If a change is significant, we will tell you in the app or by email before it takes effect and may ask you to accept the new terms before you continue. If you keep using the Service after a change takes effect, the new terms apply.
If any part of these terms is found unenforceable, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. We may transfer these terms to a business that takes over EmbroBuddy; you may not transfer them without our agreement. We may send notices to the email address on your account.
